Cheeky WhenU’s tactic maybe, but not be illegal according to Judge Nancy Edmunds who failed to see that the sites were being sabotaged: 'When WhenU's advertisements pop up and partially overlap plaintiffs' sites on the computer screen, it seems apparent to the user that what is appearing on his or her screen are two distinct sources of material.'
The ruling is likely to be welcomed by igaming sites, who heavily rely on pop-up companies for publicity. It was also applauded by the Centre for Democracy and Technology who remarked: 'From the basic details of the case, it seems as if the judge was looking at the right set of issues.' Wells Fargo was unavailable for comment.
