|State law regarding Internet Gambling was branded “unenforceable” by a special agent in charge of the Iowa Division of Criminal Investigation, Joe Diaz, who oversees the gambling industry in central Iowa.|
Diaz’s comments came in response to the growing number of offshore sites that offer gambling to Iowans on the Internet, despite the fact that it is officially illegal in the state.
Sites like BetDesMoines.com, which is based in Margarita Island in the Caribbean and boasts a client list of 1,260, say that their actions are not in violation of Iowan law because of their offshore status. Players may physically place a bet in Iowa but it is processed and run from a different location where online gambling is legal.
Assistant Iowa Attorney General Andrew Anderson said, “I think it would be likely that a state court would say, ‘if the player is sitting in your state and they are doing it from their computer, we have jurisdiction.’” Anderson went on to state that such wagers would be considered illegal in Iowa.
