Dutch ruling in favour of Ladbrokes

The first ruling has been delivered in the long running case De Lotto brought against Ladbrokes, regarding the right of the British company to offer online gambling in Holland. The judgement has been made in favour of Ladbrokes, with the judge who presided over the case issuing the following statement: 'It is for the national court to determine whether the national legislation, taking account of the detailed rules for its application, actually serves the aims which might justify it, and whether the restrictions it imposes are disproportionate in the light of those aims.'

While the judgement has deemed that Ladbrokes is free to offer the online gambling option to Dutch residents, the case will continue this year, focusing now on whether Dutch law is in line with EU policy. This follows on from Ladbrokes assertion and main argument in its case against the claims, that the Dutch policy clashed with the overriding EU legislation on the free movement of services within the EU. In this continuation of the case, the Ministry of Justice will present its case and De Lotto will be permitted to lodge any arguments and objections they might have.

A statement released by Tieerd Veenstra, the director of De Lotto, exposes that he is not unhappy with the recent ruling; 'It is good that a thorough investigation is now done into the matter. We now await the response of the Ministry. These proceedings are far from over.'
